En mi opinión, en primer plano de esa imagen sintética del derecho de obligaciones, debería estar la identificación y observación de las rationes decidendi que se utilizan para resolver conflictos, rationes que ya están enraizadas o que reaparecen en la aplicación del derecho de obligaciones, a pesar de los cambios en el contexto cultural, religioso y económico en que se aplican.
